These terms and conditions (“The terms and conditions”) govern the use of WWW.BERKSINSULATION.COM (the site). This site is owned and operated by BERKS INSULATION LTD. This site is for free* underfloor insulation and boiler replacement.
By using this site, you indicate that you have read and understood these terms and conditions and agree to always abide by them.
Intellectual Property
All content published and made available on our site is the property of BERKS INSULATION LTD and the sites’ creators. This includes, but is not limited to images, text, logos, documents, downloadable files, and anything that contributes to the composition of our site.
A customer can cancel at any time given a reasonable explanation and prior to work starting. A customer can not cancel if the job has started. If no works have started the customer does not need any notice period and can cancel the work on short notice. However, if the journey of the jobs to be completed has started then the customer can not cancel. Cancellation can be considered and are subject to the discretion of the staff.
Berks Insulation Limited mainly deals with measures funded by government schemes, however, it does not constitute the entirety of the works to be subsidised. Any works which fall outside of the scope are subject to charge and the customer must pay the charge as defined by Berks Insulation Limited or its representative prior to work commencement. The cost of additional works will be communicated to the customer prior to works, the costs can be communicated to the customer verbally or in writing (in writing is of preference, except in situations where costs are agreed on the day prior to works commencing and not enough time for the costs to be informed in writing). Commencement of works is an agreement that the customer must pay the costs informed off, if the costs are not paid, Berks Insulation Limited can claim for the monies via the court of Law.
Works Completion
A project is considered complete with the installers removing equipment from the site. It is the responsibility of the customer/householders to ensure all satisfaction checks are carried out prior to installers leaving the customer premises. Installers are only to leave customer premises once the customer is satisfied with the installation. If the customer deems the works are not completed to a satisfactory level, the customer must contact the office immediately and inform of their concern so the office can ensure the concerns are addressed soonest possible. When an installer leaves customer’s house, Berks Insulation sees the process as a job complete with a satisfied customer. If the customer is not satisfied, The customer must inform the office so that the office can take necessary steps to ensure customer satisfaction is achieved. If an engineer leaves the customer’s house, it is the heating system is functional to its full capacity and the customer is satisfied with the installation. If an insulation technician leaves customer premises following loft, internal wall or underfloor insulation the act is a declaration customer is satisfied with the service. In the case of insulation if scaffolding is removed off the premises it is a declaration customer is satisfied with the job hence the scaffolding is being removed.
The guarantees are provided by external entities. Berks Insulation only provides a warranty for the workmanship for a period of 1 year. The warranty for insulation is provided by an external guaranteed provider and not by Berks Insulation Limited. The guarantee of all boilers installed by Berks Insulation Limited via a government scheme are subject to only 2 years guarantee by the manufacturer and if the customer wishes for an extended warranty period instead of 2 years, the customer must contact the manufacturer and arrange the extended warranty directly with manufacturer. Berks Insulation Ltd has no part with an extended warranty (any duration longer than 2 years). Electronic controls installed by Berks Insulation Limited are to be registered by the householder, it is Householder’s responsibility to ensure the electronic controls are registered CUSTOMER RESPONSIBILITY TO ENSURE THE CONTROL IS REGISTERED WITH MANUFACTURER WITHIN 30 DAYS OF INSTALLATION.
Limitation of Liability
Except where prohibited by law, by using this site you indemnify and hold harmless BERKS INSULATION LTD and directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of the use of our site or your violation of these terms and conditions. Berks Insulation Limited is not liable to answer to any mediatory acting on behalf of customers such as insurance companies, and law firms perusing legal claims. The relevant companies should contact the guarantee provider
Applicable Law
The Terms and Conditions are governed by the laws of the country of England.
Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if the customer and Berks Insulation Limited are unable to resolve any dispute through informal discussion, then the customer and BERKS INSULATION LIMITED agree to submit the issue first before a non-binding mediator and to an arbitrator if mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and BERKS INSULATION LIMITED.
Now withstanding any other provision in these Terms and Conditions, the customer and BERKS INSULATION LIMITED agree that both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Additional Terms
Minor cosmetic damages will not be covered by the company if it is determined the damage could not be averted. Additional materials are not included within the grant funding such as filters (if one is currently present), New pumps, gas line upgrades, New TRV’S*, Upsized boilers i.e combi boilers any boilers above 30kw, regular and conventional boilers above 20kw, flue guards and specific controllers or boilers, zone valves.
Any damages (if any) caused by the fitters or engineers need to be reported to the company within 4 weeks from the date of installation for any claim. The claim must be accompanied by photographic evidence, only then can remediation be instructed. Anything reported at a later stage will be disregarded.
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect any changes to these Terms and Conditions or post a notice on our site.
